General Terms and Conditions for Participants of on-site and online Events of UL Method Park GmbH

Under these terms and conditions UL Method Park GmbH, (hereinafter referred to as “Method Park”) provides to its client (“you” or the “Participant”) the services in terms of type and scope following the event descriptions of the corresponding event program (the “Event”). Method Park reserves the right to exchange presenters and/or make changes to the event agenda in exceptional cases while maintaining the event’s overall character. - Registration and confirmation
The Participants must provide their registration to Method Park via email or online at process-insights.org. Method Park considers the registrations in the order of receipt. The booking becomes legally binding upon confirmation in writing (including e-mail) by Method Park. - Hotel and directions
The participants are responsible for their own accommodation (hotel). - Re-booking or cancellation by Method Park
In case of cancellation of the Event due to illness of a speaker(s), force majeure, or other circumstances beyond Method Park’s control, Method Park retains the right to cancel the Event at any time. In such cases, Method Park reserves the right to re-book participants from an on-site to similar online events instead of cancelling the Event. For re-booking, participants receive an appropriate discount in the form of a voucher, unless it was offered as a gift or planned as an on-site and online event in the first place. Participant shall have not any right to cancel or terminate nor shall Participant have a right to reimbursement. These terms shall also apply in case Method Park has already confirmed the event execution.
Method Park reserves the right to cancel the event up to 14 days before its start due to a low number of participants at Method Park’s sole discretion.
Cancellation by Method Park will result in a refund of the participation fees already paid which shall be the Participant’s sole remedy. Any claim for reimbursement of travel and accommodation costs, or a loss of working hours, is excluded unless expenses incurred due to grossly negligent or intentional behavior on the part of Method Park. - Cancellation or re-booking by participants
Participants must provide cancellations and re-bookings in writing (including e-mail). For any cancellations up to 4 weeks before the Event, Method Park may charge a cancellation fee of EUR 150.00 plus VAT for any individual Participant. Any cancellation by the Participant after this deadline, will lead to the participation fee becoming fully payable. . The receipt of written cancellation by Method Park shall be relevant. If the full participation fee is due, Method Park will send the event documents upon request after receipt of the invoice amount. A replacement for this participant can be named at any time and is free of charge. Please note that Method Park will not correct the invoice in this case. Event cancellation regulations are applied accordingly if a registered participant is absent from the event without prior notice. - Liability
The events are thoroughly prepared and conducted by qualified speakers. Method Park is not liable for the topicality, correctness, and completeness of the conference documents and event execution. Method Park is not liable for any performance failure of the event location. Method Park does not guarantee the technically perfect transmission and reception of data in the case of an online event. Method Park’s liability out of or in connection with this services and the Event shall be limited to the fee paid by the Participant. - Copyrights
All event documents – manuscripts, exercises, and case studies – are protected by copyright and are the exclusive property of Method Park. Method Park grants the participants a simple, non-transferable right of use for personal use only. Reproduction, digitalization, publication, distribution, or making the documents available for download or any other purpose outside of the event – even if only in extracts – requires the prior, explicit, and written consent of Method Park. Any copyright notices, marks, or trademarks may not be removed. Sound and image recordings of any kind are prohibited for all Method Parks event formats (on-site or online). Only registered participants may participate in online events. The Participant undertakes to protect the copyrights and use the events individually for their use only within the contractual agreement scope. Any misuse can be legally prosecuted. - Event fees
Fees for on-site events include lunch for each full conference day and drinks during breaks. - Terms of payment
The participation fees are due without any deduction after the invoice is issued, but no later than 14 days before the event start. Please transfer the participation fees only after receipt of the invoice. The invoice will be issued electronically. Please check whether a printed version of the invoice is required. For printed invoices, Method Park charges a rate of EUR 5.00. You are not entitled to offsetting, reduction, or assertion of a right of retention unless your claims are legally established or undisputed. - Place of jurisdiction and applicable law
The legal relationship of the contracting parties from or in connection with the contract is subject to the Federal Republic of Germany’s law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for legal disputes arising from or in connection with the contract is Erlangen. - Severability clause
Should a provision of the contract be or become invalid or unenforceable in whole or in part, the rest of the contract shall remain unaffected. The invalid or unenforceable provision shall be replaced with retroactive effect by the valid provision that the parties would have agreed upon from an economic point of view if they had been aware of the provision’s invalidity or unenforceability at the time of conclusion of the contract. The same applies to any loophole in the contract. - Written form
Additional agreements, amendments, supplements, or cancellation must be provided in writing (including e-mail) to be effective. This also applies to this clause. - Consent to the use of photo and film recordings of the participants
If photographs and/or film footage are taken on behalf of Method Park during an event, and these photographs and/or film footage reveal a participant, the person concerned declares his or her consent with the use hereby as well as the (free) use of the photographs of his or her person for advertising measures by Method Park for similar events, in particular through print advertising, internet, social media, other printed media, or press articles. The use of the photos or film recordings for purposes other than those described or the placing on the market by making the photographs or film recordings available to third parties is not permitted, except to press representatives for press releases of the event. Speakers and participants are not considered third parties in this respect. The person concerned also agrees that the photographs may be stored and processed by Method Park in digital form for the purposes described above.Method Park requests immediate notification at the check-in counter if the person concerned does not agree to the production of a photographic or film presentation of his or her person. The person concerned may object to any future use of his or her photographs or film recordings for advertising purposes at any time by notifying Method Park in text form. After receipt of the objection, Method Park will no longer use the concerned photographs or film recordings for advertising purposes, and will delete the digitally stored photos, provided the person is identifiable. - Consent to the disclosure of participant lists
The participant also agrees that the list of participants with the data provided by her or him (name, company) may be displayed for inspection and, in individual cases, may be passed on to other participants of the event and presented to exhibitors and sponsors to facilitate mutual contact. In exceptional cases, Method Park reserves the right to pass on the data to interested third parties. In these cases, the participants will be informed in advance. Participants may object to the use of their data for this purpose at any time by notifying Method Park informally. - Online dispute resolution platform
Under current law, Method Park must inform consumers of the existence of the European Online Dispute Resolution Platform, which can be used to resolve disputes without the need to go to court. The European Commission is responsible for setting up the platform. Please find the European Online Dispute Resolution Platform here: https://ec.europa.eu/odrMethod Park is neither willing nor required to participate in dispute resolution procedures before a consumer dispute resolution body. - Right of withdrawal for participants
Participants whose registration cannot be attributed to their commercial or self-employed professional activity (§ 13 BGB) have the right to cancel their booking in writing within 14 days of receipt of the registration confirmation without giving reasons. In this case, Method Park charges no cancellation fees. The timely dispatch of the cancellation to the following address is sufficient to meet the deadline:

These terms are governed by the laws of Germany without reference to any other jurisdiction. Any disputes shall be submitted to competent courts in Erlangen, Germany.
